Supreme Court sets up third Constitution Bench for various pending cases“.

With a number of cases involving constitutional interpretation pending before the Supreme Court, the top court has set up a five-judge bench which will start hearing on a number of matters from Tuesday.

The five-judge bench, headed by J Arun Mishra, will be hearing a series of cases, starting with a batch of petitions on the interpretation of Section 24 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement act 2013.

Section 24 of the new land acquisition Act allowed the acquired land to be given back to its “original owners”, in case the government does not complete the acquisition process within 5 years.

The issue will affect thousands of landowners and development projects across the country.

The pleas, with the title case filed by Indore Development Authority, were filed in 2016.

The pleas were filed in 2016, following conflicting judgments from Madhya Pradesh High court, Delhi High court, Madras HC and others regarding the return of acquired property and calculation of compensation to be paid.

The Constitution bench is to be headed by J. Arun Mishra. It also includes Justices Indira Banerjee, Vineet Saran, MR Shah and Ravindra Bhat.
